. >>> coming up, a new study shows how racist ohio's anti-early voting law was. nina turner is here with us. we're right back. >>> in the big finish tonight, a study is exposing how racist an anti-voting law was. it would discriminate against african-americans in ohio's second largest city of cleveland. the study found that african-americans used early in person voting at 26 times the rate of white voters in 2008. the study used census tracks where the voting population is over 80% african-american. every one of those red dots on the map represent 50 early voters. ohio republicans were trying to end early voting 72 hours prior to election day except for members of the armed forces. luckily for all ohio voters, their efforts have failed. on friday a federal appeals court judge upheld a lower courts decision striking down the law. the three-judge panel ruled the 72-hour voting period should be open to all voters in the state, including members of the military. this is good news. some questions still remain. it's being report the the final decision could be up to individual ohio counties meaning 7

. however, county by county, they can have the final say? >> well, thomas, the courts just reset the law. it went back to the original law in the state of ohio. so, all along it was up to the county boards of elections, but since the debacle of 2004, county boards have been allowing that last three days, especially in the urban counties. and let us not forget that the type of voting that the secretary of state has cut out has a disproportionate impact on african-american voters. there was just a study that came out that said that african-americans are 26 times more likely to vote early and in person than any other voter in the state of ohio. so, make no mistake about it, the republicans are doing everything they can, whether it's on the federal level or the state level, to try to target african-american voters and poor voters, but this is a victory for all voters in the state of ohio now that the last three days, the boards of elections have that discretion, but it is a victory. >> but if the secretary of state, as you say, has been trying to get this to be a tighter time period, what's

voters must be treated the same way until ohio law, but also grants ohio's 88 election boards the authority to establish how any court can consider this a remedy is stunning. now, he's saying this as his basis to appeal to the supreme court, yet clearly in the 2000 election, it showed how early voting was very crucial. 93,000 ohioans voted in the final three days of early voting in 2008. he wants that cut out this time in fact cut it out and the appeals court reversed him on it. tell me the legal interpretation you get from there. >> there's a lot of latitude in operating the functions of offices around the state, but when you were talking about the fundamental right, equal protection, equal access to the ballot that's what the court says you cannot abuse. the sixth circuit that made this decision is made up of 16 active justices, ten of them are republican appointees. the chief justice is george h.w. bush appointee. nine others from george wish one from -- so we're not talking about some radical liberal circuit court. these injureses understand this is a

this voter i.d. law the judge has blocked, at least for this general election. what do you make of those two states that you know especially well? >> well, pennsylvania, i think the voter i.d. law had the potential to affect 50, 100,000 votes. that's wiped away now. pretty clear that president obama is going to carry pennsylvania. what the surprise is ohio. always a tossup state. even in the poll today, which showed governor romney narrowing it in virginia and florida. ohio state at eight points f p if ohio folks don't move in the next days after the debate, time for romney folks to cash in ohio. >> you take the media hit for a couple of days there, but ohio, pennsylvania, they represent a type of voter or a group of voters would know romney needs. tries to make up ground on the auto bailouts saying that is not exactly what i meant at the time, i was really in line with what played out there, we know it was not but the type of voter or the group of voters in ohio that we have talked so much about, white males in particular, working class, middle class people, they are there in that state. >
